Corpus Christi Employment Law
Employment law is an area of legal practice that deals with the rights, responsibilities, and obligations of employers, employees, former employees, and prospective employees. Employment law covers legal issues such as: discrimination, sexual harassment, wrongful termination, wages, taxation, workers’ compensation, and workplace safety.
Corpus Christi Employment Law and Discrimination
When it comes to the workplace, it is illegal for an employer or an employee to exercise any form of discrimination related to a person’s age, ethnicity, gender, sexual orientation, or disability. There are several federal Acts that prohibit discrimination in the workplace. Some of these Acts are:
Title VII – prohibits companies from discriminating against prospective employees during the hiring/application process.
Age Discrimination in Employment Act – prevents employers from exercising bias against an employee due to the employee’s age.
Family and Medical Leave Act- allows employees to legally take up to 12 weeks of absence for medical purposes. An employee can take a medical related 12 week absence if he/she has worked for an employer for at least 12 months. The Act also preserves the employee’s position throughout his/her leave of absence.
Employment Law and Employee Rights
According to state and federal law, all employees and prospective employees are granted certain rights within the workplace. Employees have the right to privacy, the right to fair compensation, and the right to not be discriminated against. Employees also have the right to work in a safe, non-hazardous work environment and the right to be free from any type of harassment. Once an employee’s rights have been violated by an employer, the employee may be allowed to file an employment claim or lawsuit.
If you are an employee or a job applicant, and you feel that your rights have been violated by an employer, it is important that you speak with a qualified employment law attorney. An attorney can evaluate your case, inform you of your rights, and advise you of your legal options.
